1. Agreement to Terms

By accessing or using Tubeletter ("Service"), you agree to be bound by these Terms of Service ("Terms"). In these Terms, "we," "our," and "us" refer to Tubeletter. If you do not agree to these Terms, you may not access or use the Service.

2. Description of Service

Tubeletter is a SaaS platform that enables users to automatically generate AI-powered newsletters from Youtube video content and distribute them to subscribers via email. The Service includes features such as:

  • Connecting YouTube channels and importing video content
  • AI-generated newsletter summaries from video transcripts
  • Newsletter editing, scheduling, and email delivery
  • Subscriber management and public signup pages
  • Campaign analytics and performance tracking

3. Account Registration

To use the Service, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information
  • Maintain the security of your password and account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

You must be at least 13 years of age to create an account. By creating an account, you represent that you meet this requirement.

4. Subscription Plans and Billing

4.1 Plans

Tubeletter offers Free, Pro, and Max subscription plans. Each plan provides different feature limits, including the number of connected channels, subscribers, daily newsletter generations, and access to advanced features such as custom writing styles, multi-language support, and article editing.

4.2 Payment

Paid plans are billed on a recurring monthly or annual basis through Stripe. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. All fees are stated in US dollars unless otherwise specified.

4.3 Cancellation

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access to your paid plan features until the end of the current billing period. After that, your account will revert to the Free plan.

4.4 Refunds

Payments are generally non-refundable. If you believe you have been charged in error, please contact us at [email protected] within 14 days of the charge, and we will review your request on a case-by-case basis.

5. Acceptable Use

You agree not to use the Service to:

  • Send unsolicited bulk emails (spam) or emails to purchased or scraped email lists
  • Send content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
  • Violate any applicable laws or regulations, including anti-spam laws (CAN-SPAM, GDPR, CASL, etc.)
  • Infringe upon the intellectual property rights of others
  • Distribute malware, viruses, or any other malicious code
  • Attempt to gain unauthorized access to the Service or its related systems
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to generate content that impersonates another person or entity
  • Resell, sublicense, or redistribute the Service without our written consent

6. Content and Intellectual Property

6.1 Your Content

You retain ownership of the content you create, upload, or generate through the Service, including newsletter articles and subscriber lists. By using the Service, you grant us a limited, non-exclusive license to process, store, and transmit your content solely for the purpose of providing the Service.

6.2 AI-Generated Content

Newsletters generated by our AI are created from YouTube video content. While we strive for accuracy, AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and approving all newsletter content before it is sent to your subscribers.

6.3 Our Intellectual Property

The Service, including its design, features, code, and branding, is owned by Tubeletter and protected by intellectual property laws. Nothing in these Terms grants you a right to use our trademarks, trade names, logos, or brand elements.

7. Email Sending and Anti-Spam

When sending newsletters through the Service, you agree to:

  • Only send emails to recipients who have opted in to receive your newsletters
  • Include a functioning unsubscribe mechanism in every email (provided automatically by the Service)
  • Honor unsubscribe requests promptly
  • Include accurate sender information and a valid physical mailing address where required by law
  • Comply with all applicable anti-spam laws in your jurisdiction

We reserve the right to suspend or terminate your account if we determine, in our sole discretion, that you are sending spam or otherwise violating anti-spam regulations.

8. Subscriber Data

You are the data controller for the subscriber data you collect and manage through the Service. You are responsible for complying with all applicable data protection laws regarding your subscribers' personal information. We act as a data processor on your behalf and will process subscriber data only as necessary to provide the Service.

9. Service Availability and Modifications

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you of significant changes that affect your use of the Service.

10. Limitation of Liability

To the maximum extent permitted by law, Tubeletter and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service.

Our total aggregate liability to you for any claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

11. Disclaimer of Warranties

The Service is provided on an "as is" and "as available" basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that AI-generated content will be accurate or suitable for your purposes.

12. Indemnification

You agree to indemnify, defend, and hold harmless Tubeletter and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, your violation of these Terms, or your violation of any rights of a third party.

13. Termination

We may suspend or terminate your access to the Service at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms. Upon termination, your right to use the Service ceases immediately. You may delete your account at any time through your account settings.

Upon account deletion, we will remove your personal data within 30 days in accordance with our Privacy Policy, except where retention is required by law.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of competent jurisdiction.

15. Changes to These Terms

We reserve the right to update these Terms at any time. We will notify you of material changes by posting the revised Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.
